The Department of Home Affairs refused the original nomination application, which had been lodged by the client’s previous migration agent, on the basis that the position was not genuine.
In its decision, the Administrative Appeals Tribunal noted that it had far greater relevant documentary evidence before it than was available to the delegate of the Department of Home Affairs.
The written submissions and documentary evidence provided to the Administrative Appeals Tribunal satisfied the AAT that the position associated with the nominated occupation was genuine.
Moreover, the AAT found the arguments submitted for the client so compelling that a hearing was not necessary. The Administrative Appeals Tribunal was able to decide in favour of the client based on the written submissions and provided evidence.
